E-learning and Copyrights

Below is presented information on copyrights in the context of e-learning. The materials were prepared on the basis of consultation with specialists from the Faculty of Law and Administration at the University of Silesia in Katowice.

INFORMATION FOR STUDENTS AND DOCTORAL STUDENTS

Due to the introduced obligation to conduct classes using distance learning methods and techniques at the University of Silesia, we would like to make you aware of the problem of protection of copyrights to the materials shared with you.

The teaching materials which you receive can only be used for learning and, pursuant to Art. 23 of the Act on Copyright and Derivative Rights of 1994, you are not allowed to distribute them (i.e. to share them with other people). This restriction concerns both the teaching materials provided to you and any kind of copies, photos or screenshots.

It doesn’t matter whether the materials are signed or labelled in any way – if they are made available by academics on university platforms, it means that the copyrights belong to the academic and University of Silesia (in accordance with the Rules and Regulations for Protection, Use and Management of the Results of Intellectual Work at the University of Silesia in Katowice and commercialisation rules).

Regardless whether you will make them available against payment or free of charge, for commercial or research purposes. In each such case, you can only make the materials available upon consent of the academic who shared them with you.

A particularly serious infringement of copyrights is to publish protected teaching materials on any type of forum, chat or website, such as chomikuj.pl or ściąga.pl. The very fact of publishing materials of which you are not the author in public online space outside the University is an infringement of copyrights.

Legal consequences:

distribution of teaching materials without the lecturer's consent may result in disciplinary action and financial claims, if the University or the lecturer suffers a loss due to such infringement of copyrights. Moreover, pursuant to Art. 79 of the Act on Copyright and Derivative Rights, the lecturer or University may take legal action, demanding both compensation for material damage and punishment of perpetrator (fine, limitation of liberty, or even deprivation of liberty – pursuant to Art. 116 of the Act).

The e-mail addresses of all recipients of teaching materials are known, so it will not be very difficult to find the perpetrator. Therefore, please do not expose yourself or others to severe legal and financial consequences of unsophisticated behaviour.

INFORMATION FOR ACADEMICS

Due to the introduced obligation to conduct classes using distance learning methods and techniques at the University of Silesia, we would like to make you aware of the problem of protection of copyrights to the materials shared with you.

First of all, pursuant to Art. 27 Par. 1 and 2 of the Act on Copyright and Derivative Rights of 1994, you can only share materials which have already been shared before (in original or translated version), only to illustrate your own content provided for teaching purposes. Therefore, you cannot scan excerpts of works of which you are not the author (manuals, articles) and make them available to students. In this respect, please ask the digital library to make materials available to students.

Secondly, you can publish links to websites, but only those which are generally available, without bypassing potential safeguards or providing access e.g. to subscription websites.

Thirdly, by sharing materials with students we somehow act at our own risk: we are not able to effectively secure materials against copying. You should apply any possible measures to make students aware of the copyright protection, such as signing materials, including the “All copyrights reserved” or “Copyright by...” information, placing the watermark, short period of material publication on the website, etc., however, the truth is that it will not prevent from infringement of copyrights, but only make it easier to potentially pursue claims in court, although this should rather be avoided. Apart from this, a student has the right to make a copy of materials obtained from you and does not have to remove it when the class has finished. This entitlement results from Art. 23 of the Act on Copyright and cannot be excluded.

Another important information - materials protected by copyrights (both own and someone else’s) should be shared in web locations that are dedicated and recommended by the University of Silesia, i.e. Internal systems (e.g. Moodle). Creating groups on Facebook is subject to the risk of infringement of copyrights or losing control of your content (teaching materials).

Please also remember that if you are sharing your materials which have already been published, it is you who may infringe the copyrights, particularly if you had previously concluded an agreement transferring such copyrights to the University of Silesia Press, although the University of Silesia Press should either give their consent to such activity, or not pursue claims. It might be different in the case of commercial publishers.
